Terms and Conditions Pertaining to Wildlife Mounts
By participating in this auction, the bidder agrees to the following terms and conditions:
Location
Auction location is: 1601 S Anderson Newton, KS 67114.
Online bidding starts Wednesday May 1, 2024, at 2:00 PM CST with online and live bidding starting at 2:00 PM May 9, 2024 with lot #1 and ending the sale with lot #100.
Payment Date
All purchases to be paid in full within 24 hours after auction ending. All payments not received, or staff notified of alternative plans by May 10, 2024 at 4:00 PM will be charged an additional 5% late payment fee. The fastest and most convenient way to pay once you receive your online invoice is to pay by credit card and to pay your invoice immediately.
If you are the winning bidder and default by failing to adhere to these terms and conditions your account with the Auction Specialists, LLC will be suspended.
We will be accepting payments on site.
Item Pickup Date
Item load out will be Friday May 10, 2024, and Saturday May 11, 2024 from 9:00 AM to 3:00 PM.
Merchandise becomes the full responsibility of the bidder at time of payment and the bidder assumes all risk of loss and damage to property at that time. In any such event, the bidder will be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
Buyer’s Premium
A buyer’s premium of 10% of the high bid will be added to the highest bid to determine the full sales price for the price lot. Example: $100 bid + $10 buyer premium= $110.
No sales tax to be applied.
Bid Increments
Bid Increments are as follows: Under $50. $10
$51-$500. $25 $501-$5000. $100 Over $5000. $500
Auction Ending
The auction will end on each lot, starting with #1 when auctioneer says “Sold”.
No Reserves
Each lot will sell to the highest bidder without reserve, unless noted otherwise.
No returns
All sales are final and there are no returns, refunds, credit card charge-backs or adjustments.
Debt Collection and Interest Charges
The bidder agrees to pay all reasonable attorney fees and other costs incurred by Auction Specialists, LLC in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to the unpaid balance due Auction Specialists, LLC. Any debt collection or dispute proceedings will be heard in District Court, Harvey County, KS.
Guaranty Agreement
By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees the payment to Auction Specialists, LLC of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorneys fee.
Limitation of Liability
If, for any reason Auction Specialists, LLC is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Auction Specialists, LLC if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.
Disclaimer
All lots sell as is, where is, with all the faults. Auction Specialists, LLC and the seller do not give or make any type of guarantee or warranty regarding lots to be sold, implied or otherwise. Auction Specialists, LLC encourages all bidders to inspect lots in person before bidding. Auction Specialists, LLC not is responsible for incorrect listing information, if any. Auction Specialists, LLC has attempted to provide accurate description of all items, however, it is the bidder’s responsibility to determine the condition or the suitability of each lot. Any announcement at the time or during live auction take precedence over printed materials or statements. Printed materials, statements or descriptions by Auction Specialists, LLC staff are provided in good faith and are matters of opinion.
Bidder Information and Security
All registration information of the bidder provided to Auction Specialists, LLC shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers or passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Auction Specialists, LLC if they believe that the bidder number and password have been compromised.
Server and Software Technical Issues
In the event there are technical difficulties related to the server, software and any other online auction- related technologies, Auction Specialists, LLC reserves the right to extend bidding, close the bidding, temporary suspend bidding, void any sale and re-sell any lots that were affected by any malfunction. Neither the company providing the software nor Auction Specialists, LLC shall be held responsible for a missed bid or the failure of the software to function properly for any reason. Email notifications will be sent to registered bidders with updated information as deemed necessary by Auction Specialists, LLC.
Age Requirement
All bidders must be 18 years of age or older.
